BlackBet operates under a license issued by the Government of Curacao. Users agree that the Company’s governing laws and jurisdictional authority rest exclusively within Curacao. BlackBet reserves the right to modify, amend, or alter these Terms and Conditions at any time, with or without notice.

1. Acceptance of Terms

• Accessing or using BlackBet constitutes acceptance of these Terms and Conditions in full. BlackBet may, at its sole discretion and without prior notice, modify these terms. Continued use of BlackBet services after any modifications constitutes acceptance of the revised terms.

2. Eligibility Requirements

6. Cashback on Lost Bets Program

• The Company may, at its sole discretion, offer a cashback program on lost bets as part of a limited, non-binding promotional activity. Cashback rates and conditions are subject to change without prior notice.
• Cashback is provided exclusively as a bonus and may be subject to wagering requirements. BlackBet reserves the right to alter, suspend, or terminate the cashback program without liability or explanation.

7. VIP and Loyalty Program

• BlackBet’s VIP program is an invitation-only feature that may be modified, suspended, or discontinued at the Company’s discretion, with or without notice. Users agree that VIP status and associated rewards are privileges granted by BlackBet and not contractual rights.
• BlackBet reserves the right to adjust, withhold, or revoke VIP rewards, including cashback, bonuses, and other privileges, at any time and for any reason, with or without prior explanation.

8. BlackBet Card Program

• BlackBet’s Card program may offers users cashback on BlackBet-related transactions and selected purchases. The Company is not responsible for third-party transaction fees, limitations, or issues arising from the use of the crypto card outside of the platform.
• BlackBet reserves the right to modify, suspend, or terminate the Card program at any time, without liability for any loss or inconvenience arising from such actions.

9. Responsible Gaming and Self-Exclusion

• While BlackBet promotes responsible gambling practices, it assumes no liability for users who fail to adhere to responsible gambling guidelines. BlackBet may, at its discretion, impose restrictions or limitations on accounts exhibiting potentially harmful gambling patterns.
• BlackBet may provides self-exclusion and limit-setting tools but assumes no obligation to monitor user activity or enforce responsible gambling measures beyond those explicitly chosen by the user.

10. License and Jurisdiction

• BlackBet operates under a Curacao eGaming license. By using BlackBet, users agree that any legal matters arising from these Terms and Conditions are subject to the laws of Curacao, to the exclusion of all other jurisdictions. Users waive the right to any alternative forum or venue.
• BlackBet is not liable for providing services in jurisdictions where online gambling is prohibited or restricted. Users are solely responsible for ensuring compliance with local laws.

11. Privacy and Data Use

• By using BlackBet, users consent to the collection and processing of personal data in accordance with our Privacy Policy. BlackBet reserves the right to modify data collection and usage practices at any time without prior notice.
• BlackBet assumes no liability for unauthorized access or misuse of personal data by third parties, whether resulting from security breaches or legal requirements.

12. Intellectual Property Rights

• All content on BlackBet, including but not limited to text, graphics, logos, and software, remains the exclusive property of BlackBet. Unauthorized use, reproduction, or distribution is strictly prohibited and may result in legal action.

13. Blockchain and Fiat Funds Security and Risk of Loss

• Blockchain Security: BlackBet employs reasonable security measures to protect its blockchain assets, including but not limited to encryption, secure wallets, and multi-factor authentication. However, BlackBet assumes no liability for any losses, including partial or total loss of user funds, resulting from unauthorized access, hacking, security breaches, or any compromise of BlackBet’s blockchain addresses or digital wallets. By using BlackBet’s services, users acknowledge and accept that any cryptocurrency funds held with BlackBet are at risk and that they bear full responsibility for any losses incurred. BlackBet is under no obligation to reimburse, compensate, or otherwise restore funds lost due to a security breach or unauthorized access to the Company’s blockchain infrastructure.
• Fiat Funds Security: BlackBet holds users' fiat currency funds in aggregated bank accounts at one or more financial institutions. Users understand and accept that these funds are not held in separate accounts under each user's name but are instead pooled with the Company’s overall funds. In the event of any failure, insolvency, or refusal by these financial institutions to pay funds back to BlackBet, users may experience a partial or total loss of their fiat balances. BlackBet assumes no obligation or liability to reimburse, compensate, or otherwise restore fiat funds lost due to such an occurrence.

By using BlackBet, users release the Company from any claims, damages, or liabilities arising from the loss of funds due to either blockchain security breaches or banking institution failures, acknowledging that such losses may be irreversible.

14. Limitation of Liability and Indemnification

• Limitation of Liability: BlackBet, including its directors, employees, agents, or affiliates, shall not be liable for any direct, indirect, incidental, or consequential damages arising from or related to the use, inability to use, or performance of its services. Users assume full responsibility for all risks and potential losses incurred.
• Indemnification: Users agree to indemnify, defend, and hold harmless BlackBet, its affiliates, and representatives from and against any claims, damages, losses, or expenses, including attorney fees, arising from their use of the platform or violation of these Terms and Conditions.

15. User Verification and Restriction of Deposit/Withdrawal

Loss of Free Bets, Bonuses, and Account Balance: In cases where fraudulent activities, unauthorized access, cheating, misuse of promotional offers, or the involvement of illegal funds are suspected or confirmed, BlackBet reserves the right to forfeit any free bets, bonuses, winnings derived from such promotions, or your entire account balance, as applicable.

16. Dispute Resolution and Exclusive Arbitration

• No Personal Claims Against BlackBet Personnel: By using BlackBet’s platform, you agree that all claims, complaints, or legal actions must be directed exclusively toward BlackBet as an entity. You expressly waive any right to pursue claims against individual owners, directors, officers, employees, agents, or other representatives of BlackBet.
• Exclusive Rights of BlackBet: BlackBet retains the exclusive right to initiate legal action to protect its intellectual property, proprietary rights, and reputation in the market. In such cases, BlackBet may seek injunctive relief or any necessary legal recourse and retains the exclusive right to select the court jurisdiction for any necessary legal proceedings.
• Final and Binding Decision: The decision of the arbitrator shall be final, conclusive, and binding on all parties. No appeals will be permitted, except as allowed by applicable law in the chosen jurisdiction.
• Governing Law: This Arbitration Agreement, along with all related claims or disputes, shall be governed by the laws of the jurisdiction selected by BlackBet, providing the most appropriate legal environment for efficient dispute management.

17. Amendments and Modifications to Terms

• BlackBet reserves the right to amend, modify, or update these Terms and Conditions at any time, with or without notice. Continued use of the platform after any changes constitutes acceptance of the revised terms.

18. Account Suspension and Termination

• BlackBet reserves the right to suspend or terminate accounts, at its sole discretion, for any conduct it deems inconsistent with these Terms and Conditions or detrimental to the operation of the platform.
• Suspension or termination is final and binding. Users acknowledge that BlackBet assumes no liability for actions taken under this clause, including but not limited to loss of account balance or promotional rewards.
